Service-dog rights in Illinois

Service-dog access in the United States is governed primarily by federal law. The Americans with Disabilities Act (ADA) Title III protects access to public accommodations, the Fair Housing Act (FHA) covers housing, and the Air Carrier Access Act (ACAA) covers air travel. These rights apply in every state — including Illinois. Whether you live in Chicago, Aurora, Naperville, or anywhere else in Illinois, the federal protections move with you. State law (775 ILCS 30/ (White Cane Law) and 720 ILCS 630) supplements those federal protections. Illinois penalizes both denial of access and misrepresentation of an animal as a service animal under separate criminal statutes. To be clear: there is no federal service-dog registry, and no Illinois law requires registration. What USAR provides is a documentation toolkit — Wallet pass, printed ID card, public QR link — that helps you avoid friction at the door. We're not a letter mill. We don't sell ESA letters or doctor notes. We register service animals and ship real ID cards.

Illinois service-dog FAQ

Do I need to register my service dog in Illinois?

No. Federal ADA law does not require registration, and Illinois does not require registration. Service-dog rights attach to the dog's training and the handler's disability, not to any document. That said, handlers in Illinois consistently tell us a real photo ID card and a scannable Wallet pass make day-to-day interactions faster — fewer arguments at restaurants, smoother check-ins at hotels, less back-and-forth at the gate.

What protections cover service-dog handlers in Illinois?

Three federal laws cover Illinois handlers: ADA Title III for public spaces, the FHA for housing, and the ACAA for air travel. Illinois adds state-level protections under 775 ILCS 30/ (White Cane Law) and 720 ILCS 630. The combined effect is broad — public accommodations, rental housing, airports, and many private settings are all covered.

Can businesses in Illinois ask about my service dog?

Yes — but only two specific questions, and only if the dog's role isn't obvious. Business staff can ask: (1) Is the dog a service animal required because of a disability? and (2) What work or task has the dog been trained to perform? They cannot ask about your disability, demand documentation, require the dog to demonstrate the task, or charge a pet fee. That's federal ADA law, applied uniformly in Illinois.

Can I bring my service dog into businesses in Illinois?

Yes. Restaurants, hotels, retail stores, transit, hospitals, and government buildings throughout Illinois are all covered by ADA Title III. 775 ILCS 30/ (White Cane Law) and 720 ILCS 630 adds state-level enforcement. A business can only deny access if the dog is out of control, not housebroken, or — rarely — operating in a fundamentally incompatible environment like an operating room.

Can my landlord deny my service dog in Illinois?

In almost every case, no. The FHA requires landlords to grant reasonable accommodation for service dogs and emotional support animals — including in "no pets" buildings — and forbids pet deposits or pet fees for them. Illinois state housing law provides parallel coverage. Landlords can deny accommodation only in narrow situations (the animal poses a direct threat, the request creates an undue burden).

Can my service dog fly with me out of ORD (Chicago O'Hare International)?

Yes. Under the Air Carrier Access Act, U.S. airlines must allow trained service dogs in the cabin at no extra fee. Most carriers require the DOT Service Animal Air Transportation Form to be filed 48 hours before departure — that form is included in USAR's Premium and Elite tiers. Submit it to the airline directly through their accessibility portal.

Can businesses confirm my registration is real?

Yes. Every USAR record has a public verification URL. Your QR code on the printed ID card and Wallet pass links straight to usserviceanimalregistrar.org/verify/?reg=YOUR-ID. Anyone with a smartphone camera can scan and see the record live — handler, dog, status. The Wallet pass updates automatically when the underlying record changes, so verification stays accurate.
