Service-dog rights in Delaware
Service-dog access in the United States is governed primarily by federal law. The Americans with Disabilities Act (ADA) Title III protects access to public accommodations, the Fair Housing Act (FHA) covers housing, and the Air Carrier Access Act (ACAA) covers air travel. These rights apply in every state — including Delaware. Whether you live in Wilmington, Dover, Newark, or anywhere else in Delaware, the federal protections move with you. State law (16 Del. C. § 9501 et seq. (Equal Rights to Public Facilities)) supplements those federal protections. Delaware extends statutory rights of equal access to handlers of trained service animals and assistance animals. To be clear: there is no federal service-dog registry, and no Delaware law requires registration. What USAR provides is a documentation toolkit — Wallet pass, printed ID card, public QR link — that helps you avoid friction at the door. We're not a letter mill. We don't sell ESA letters or doctor notes. We register service animals and ship real ID cards.

Delaware service-dog FAQ
Does Delaware require service-dog registration?
Delaware does not require service-dog registration, and federal law does not either. The ADA explicitly forbids businesses from demanding certification or registration documents. What we provide at USAR is optional documentation — a real ID card, a Wallet pass, a public verification URL — that handlers find useful day-to-day even though it isn't legally required.
What protections cover service-dog handlers in Delaware?
Three federal laws cover Delaware handlers: ADA Title III for public spaces, the FHA for housing, and the ACAA for air travel. Delaware adds state-level protections under 16 Del. C. § 9501 et seq. (Equal Rights to Public Facilities). The combined effect is broad — public accommodations, rental housing, airports, and many private settings are all covered.
Can businesses in Delaware ask about my service dog?
Yes — but only two specific questions, and only if the dog's role isn't obvious. Business staff can ask: (1) Is the dog a service animal required because of a disability? and (2) What work or task has the dog been trained to perform? They cannot ask about your disability, demand documentation, require the dog to demonstrate the task, or charge a pet fee. That's federal ADA law, applied uniformly in Delaware.
Where can my service dog go in Delaware?
Anywhere open to the public — restaurants in Wilmington, hotels statewide, grocery stores, hospitals, taxis and rideshare, trains and buses, government buildings, and most private businesses. The ADA carves out only narrow exceptions (sterile hospital environments, situations where the dog is out of control or not housebroken). Outdoor public spaces — parks, beaches, transit hubs — are also covered.
Can my landlord deny my service dog in Delaware?
In almost every case, no. The FHA requires landlords to grant reasonable accommodation for service dogs and emotional support animals — including in "no pets" buildings — and forbids pet deposits or pet fees for them. Delaware state housing law provides parallel coverage. Landlords can deny accommodation only in narrow situations (the animal poses a direct threat, the request creates an undue burden).
Do I need anything special to fly with my service dog from PHL (Philadelphia International, serving Delaware)?
Yes — the DOT Service Animal Air Transportation Form. The ACAA requires it for most U.S. airline cabin travel. PHL (Philadelphia International, serving Delaware) handlers should submit the form to their airline at least 48 hours ahead. USAR's Premium and Elite packages include this form; it's also available standalone from the U.S. Department of Transportation.
Can businesses confirm my registration is real?
Yes. Every USAR record has a public verification URL. Your QR code on the printed ID card and Wallet pass links straight to usserviceanimalregistrar.org/verify/?reg=YOUR-ID. Anyone with a smartphone camera can scan and see the record live — handler, dog, status. The Wallet pass updates automatically when the underlying record changes, so verification stays accurate.
